This may include your name, email, phone number, login name and password, address, payment or banking information (including related payment verification information), government identification numbers such as PAN number, driver’s license or passport if required by law, birth date, photo and signature. This also includes the preferences and settings that you enable for your PayGyft account Email
    • Background check information: We may collect background check information if you sign up to use PayGyft’s services as a merchant or seller. This may include information such as your criminal record (where permitted by law). This information may be collected by a vendor on PayGyft’s behalf.
    • Demographic data: We may collect demographic information about you, including through user surveys. In some countries, we may also receive demographic information about you from third parties.
    • User content: We may collect information that you submit when you contact PayGyft customer support, provide ratings or compliments for other users, or otherwise contact PayGyft.

    • Location Information Depending on the PayGyft services that you use, and your app settings or device permissions, we may collect your precise or approximate location information as determined through data such as GPS, IP address and WiFi.
      • If you are a customer and have provided permission for the processing of location data, PayGyft collects location information when the PayGyft app is running in the foreground. In certain regions, PayGyft also collects this information when the PayGyft app is running in the background of your device if this collection is enabled through your app settings or device permissions.
      • Customers and delivery recipients may use the PayGyft app without enabling PayGyft to collect their location information. However, this may affect the functionality available on your PayGyft app. For example, if you do not enable PayGyft to collect your location information, you will have to manually enter your location or you can’t access In-Store details nearest to your place..
    • Transaction Information We collect transaction details related to your use of our services, including the type of services you requested or provided, your order details, delivery information, date and time the service was provided, amount charged, and payment method. Additionally, if someone uses your affiliate code, we may associate your name with that person.
    • Usage information We collect information about how you interact with our services. This includes information such as access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or service you were using before interacting with our services. In some cases, we collect this information through cookies, pixel tags, and similar technologies that create and maintain unique identifiers.     • Device Information We may collect information about the devices you use to access our services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.
    • Communications data We enable users to communicate with each other and PayGyft through the PayGyft apps, websites, and other services. For example, we enable merchants and customers, and delivery partners and recipients, to call or text each other. To provide this service, PayGyft receives some information regarding the calls or texts, including the date and time of the call/text, and the content of the communications. PayGyft may also use this information for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services and for analytics.

3. Information from other sources

These may include:

  • User feedback, such as as ratings or compliments.
  • Users providing your information in connection with referral programs.
  • Users requesting services for or on your behalf.
  • Users or others providing information in connection with claims or disputes.
  • PayGyft business partners through which you create or access your PayGyft account, such as payment providers, social media services, or apps or websites who use PayGyft’s APIs or whose API PayGyft uses.
  • Financial services providers (if you are a merchant or seller).
  • Partner logistics companies (if you are a seller who uses our services through an account associated with such a company).
  • The owner of a PayGyft for Business or PayGyft Family profile that you use.
  • Publicly available sources.
  • Marketing service providers.
  • PayGyft may combine the information collected from these sources with other information in its possession.

Mobile Application Permissions

  • LOCATION - To locate nearby PayGyft participating outlets.
  • PHONE - We are using this information to provide the functionality to call the customer care/participating merchants directly.
  • PHONE STATE - To identify cellular network information for optimising performance on low bandwidth network.
  • CAMERA - To provide image search and contact customer care with the images.
  • STORAGE - To store or access photos captured by you at the time of contacting customer care or image search.
  • SMS - To read OTP received automatically while making the delivery address change.
  • ACCOUNT - We are using account's email id to send email notifications.
  • CONTACT - Read your contact card for Invite feature.

USE OF INFORMATION & DISCLOSURE

We may use Personal Information for the purposes for which you specifically provided it including, without limitation, to enable us to respond to your inquiries and process and fulfill your requests;

  • Our primary goal in collecting your information is to provide you with an enhanced experience when using the Services. We use your information to closely monitor which features of the Services are used most, to allow you to view your shopping history, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources.
  • Based upon the Protected Information you provide us when registering for an account, we will send you a welcoming email to verify your username and password.
  • We use the information collected from our Mobile Application so that we are able to serve you the correct app version depending on your device type, for troubleshooting and in some cases, marketing purposes.
  • We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our website(s). Your IP address is used to help identify you, but contains no personal information about you.
  • We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email. If you do not wish to receive them, you have the option to deactivate your account.
  • We may use the information obtained from you to prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, and to investigate fraud, chargeback or other matters.

  • We may use the information collected from you for targeted advertising. PayGyft will share some or all of the User Information with another entity should PayGyft merge with, or be acquired by that entity or receive investments from that entity.

PayGyft may disclose aggregated information about the use of the Website, but it will never contain User Information that will identify a single user. PayGyft does not trade or sell User Information in any manner, except as specified in this Policy or if express consent is sought from the user. PayGyft understands that the User Information is very crucial and is important for the user. PayGyft may, if the user so chooses, send direct advertisement mailers to the user at the address given by the user. The user has the option to opt-out of this direct mailer by clicking at the unsubscribe link option attached to e-mail. PayGyft respects the user’s privacy and if the user does not want to receive e-mail or other communications from PayGyft, user may inform the same to our customer care service.

SECURITY & USER RESTRICTION

PayGyft implements standard measures to protect against unauthorized access to and unlawful interception of the User Information. However, no internet site can fully eliminate security risks. PayGyft endeavors to take all measures to protect the security, integrity and confidentiality of the User Information against unauthorized breach and hacking. For the purpose of checking possible vulnerabilities and attacks, PayGyft may conduct periodical internal review of data and security measures on the Website. PayGyft may use such software as it determines is best for maintaining security. However the internet is not absolutely a secure environment, and the Website cannot ensure or warrant a 100% security of the User Information.

The user is solely responsible for the activities that occur under the user’s account including the confidentiality of the user’s password and PayGyft is not responsible for the same. While using and accessing the Website, the user is responsible for maintaining the confidentiality of the user’s account and for restricting access to the user’s computer or other system or equipments through which the user uses and accesses the Website.

Notwithstanding anything contained in this Policy or elsewhere, PayGyft shall not be held responsible for any loss, damage or misuse of the User Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" means any event that is beyond the reasonable control of PayGyft and includes, without limitation, fire, flood, explosion, acts of God, civil commotion, strikes, lock outs or industrial action of any kind, riots, insurrection, war, acts of government, power failure, sabotage, computer hacking, unauthorised access to computer data and storage device, system failure, virus, attacks, bugs, computer crashes, breach of security and encryption.

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked websites. Nonetheless, we seek to protect the integrity of our website and welcome any feedback about these websites.

The linked websites or advertisers are not necessarily under the control of PayGyft and PayGyft expressly disclaims all liability associated with the content and the use of such websites and advertisements. Display of any third party advertisements on the Website shall not be construed as an endorsement or promotion of any products or services by PayGyft. The user should read the privacy policy of each and every linked website and any access or use of the linked websites is entirely at the user’s own risk. PayGyft is not responsible for any direct, indirect, solicited or unsolicited communication made by any of these linked third party websites or advertisers or their respective agents or representatives, to the users including by telephone, email, mobile phones and facsimile.

Based on the User Information including the nature of products purchased by the user through the Website, PayGyft may display personalized third party advertisements on the Website. When the user clicks on the advertisement link, the third party advertisers may assume that the user has met the criteria that was used to personalize the advertisement. The user acknowledges and agrees that in no event PayGyft is responsible to the user accessing the services of third party advertisers or other websites.

GENERAL TERMS

The User Information resides in PayGyft’s database for a certain period of time even after the user ceases to use or access the Website and in such cases PayGyft is not be liable for any usage of the User Information after the user ceases to use or access the Website.

The Users agree and acknowledge that User Information collated through the Website could be stored and processed in any other country across the world. The users acknowledge that for effective provision of the Website’s services in respective territories including territories outside India, the User Information may be stored or processed by trusted third parties.

The user should be aware that the User Information or other data, the user provides to the Website for availing the services or transacting through the Website could be read, collected, or used by other users or third parties in which case the User Information might be used for sending unsolicited messages or communications for which PayGyft is not responsible.

The user agrees and acknowledges PayGyft’s right to utilize the user’s posts, contents, information and other personal data for the purpose of providing services through the Website. The contents on the Website may contain comments, post and reviews posted by the users which may be public and searchable on the internet in which case the user’s comments, post reviews and information and personal data provided to the Website may be viewed by other users and PayGyft cannot guarantee that other users or third parties have not made copies of or used the ideas and information that the user has shared on the Website.

HOW WE USE COOKIES
